중재란 분쟁 당사자 간의 합의로 법원의 재판이 아닌 당사자들이 선정한 중재인의 판정에 의하여 분쟁을 최종 해결하는 제도입니다.

당사자 간 합의로 분쟁이 생겼을때 법원이 아닌 대한상사중재원(KCAB)의 중재에 의한다는 계약서 작성을 통해 아래와 같이 관할을 대한상사중재원의 중재로 정할 수 있습니다.

▶ 중재의 특징

중재는 각 분야의 전문가인 중재인이 판정을 내리므로 법률전문가인 판사의 판결과 차이가 있습니다.

​

중재는 단심제로 진행되므로 시간과 비용을 절약할 수 있습니다.

​

중재판결문은 법원의 확정판결과 동일한 효력이 있으며 뉴욕협약에 의하여 국제적 효력도 인정됩니다.

​

중재는 원칙적으로 비공개심리로 진행되므로 당사자가 기업인 경우 비밀보장에도 기여합니다.

​

상대적으로 서면으로 진행하는 판결과 다르게 당사자들의 충분한 진술 기회를 보장합니다.

Arbitration is a system in which a dispute is finally settled by the arbitrator's decision selected by the parties, not by a court trial, by agreement between the parties to the dispute.

In the event of a dispute due to an agreement between the parties, it can be determined by the arbitration of the Korean Commercial Arbitration Board (KCAB), not by the court.

▶ Characteristics of arbitration



Arbitration is different from the judgment of the judge, who is a legal expert, because the arbitrator, who is an expert in each field, makes a decision.

​

The arbitration will be conducted on a single-trial basis, which will save you time and money.

​

The arbitral judgment has the same effect as the final judgment of the court and is recognized internationally by the New York Convention.

​

In principle, arbitration is conducted in a closed hearing, so if the party is a company, it also contributes to confidentiality.

​

Unlike the relatively written judgment, it guarantees sufficient opportunities for the parties to make statements.
